Preamble

The Landlord operates the property at Hauptstraße 357, 53639 Königswinter as a boarding house for temporary stays of between 1 and 12 months. The furnished rooms are offered in different sizes (17 sqm - 35 sqm). Common rooms/common areas can be used, hotel-like services are included (details can be found in the enclosed service description).

1. Terms and Conditions

1.1 Scope of application

These General Terms and Conditions (GTC) apply to all rental contracts for the rental of furnished apartments in the Eldalio co-living offer in Königswinter, near Bonn and Cologne. By booking via the online platform of KR Hotelbetriebs GmbH (hereinafter referred to as the "Landlord"), the Tenant (hereinafter referred to as the "Tenant") accepts these GTC.

1.2 Contracting parties

The contractual partners are KR Hotelbetriebs GmbH, Hauptstraße 374, 53639 Königswinter, as the landlord and the respective tenant who books an apartment via the online platform.

1.3 Service description

The landlord provides the tenant with a furnished room for residential use within the property. Use of common rooms and facilities is included in accordance with the current service description. Subletting or commercial use is not permitted. The apartments are cleaned weekly. Details can be found in the rental agreement and these terms and conditions.

2. Booking Process and Conclusion of Contract

2.1 Booking and Checkout

When the tenant completes the checkout process via the online platform, they authorize payment for the first rental period. By completing checkout, the tenant acknowledges and agrees to these GTC, the house rules, and confirms their intent to enter into a rental agreement. The tenant acknowledges that the payment made during checkout covers only the first rental period.

2.2 Receipt of Rental Agreement

After successful completion of checkout and payment, the tenant will receive a digital rental agreement via DocuSign for review and signature. The binding rental contract is only concluded upon the tenant's signature of the rental agreement. The contract will detail all terms including the rental period, payment schedule, and other specific arrangements.

2.3 Processing Fee for Non-Completion

By completing checkout and making payment, the tenant acknowledges that if they fail to sign the rental agreement before moving in (and within 5 days) of receipt, a processing fee of 15% of the first period payment will be charged. This fee covers administrative costs, reservation holding, and opportunity costs. The remaining 85% will be refunded to the original payment method within 14 business days.

2.4 Fixed-term tenancy

The rental period is determined individually and is stated in the rental agreement. The tenancy ends automatically at the end of the agreed rental period. An extension of the tenancy by tacit continuation of use after expiry of the rental period is expressly rejected (§ 545 BGB). On the last day of the agreed rental period, the tenant must vacate the room by 12:00 noon and return possession to the landlord.

2.5 No right of withdrawal

As this concerns the provision of accommodation services for a specific period of time, there is no right of withdrawal in accordance with Section 312g (2) No. 9 BGB once the rental agreement is signed.

3. Rental period and use

3.1 Use of the rented premises

The tenant is entitled to use the rented apartment and the communal areas in accordance with the house rules. Use is limited to the contractually agreed rental period. The apartment may only be used by one person.

3.2 House rules

The house rules are an integral part of these GTC and the rental agreement. The tenant undertakes to comply with the house rules and to ensure that his guests comply with them.

4. Remuneration and Payment Terms

4.1 Total Rent

The total rent for the full rental term is specified individually in the rental agreement, inclusive of furniture, utilities, and communal-area use. If booked, extra services (e.g., parking, A/C usage) are listed separately.

4.2 Payment Processing via Stripe

All rent payments are processed securely via Stripe checkout sessions and invoices. Each payment will generate a digital receipt. The Tenant agrees that payment confirmation via Stripe constitutes valid proof of payment.

4.3 Payment Schedule

The payment for the first rental period is due immediately through Stripe checkout. The rent for each upcoming period is due in advance by 7 days before the start of the next period. In case of automated split payments through Stripe, the specific schedule is detailed in the rental agreement and payment overview. Payments must reach the Landlord's Stripe account or the provided bank account within the deadlines.

4.4 Default

If payment is not received by the due date, the Tenant enters default automatically, without separate reminder. If arrears exceed 7 days, the Landlord may terminate the tenancy without notice (§ 543 BGB).

4.5 Deposit

The tenant must pay a deposit of €550 before the room is handed over. The Deposit is to be made to the following account of the landlord:

The deposit will be refunded after the tenant has moved out, subject to any damage that can be proven to have been caused by the tenant.

5. Rights and obligations of the tenant

5.1 Care of the rented property

The Tenant undertakes to treat the apartment and the common areas with care. In particular, the Tenant is obliged to report any damage or defects to the Landlady without delay.

5.2 Liability for damage

The Tenant shall be liable for all damage to the rented property or the communal areas caused by him, his guests or other third parties up to the amount of the replacement costs. Liability also includes consequential damage caused by late notification of defects.

5.3 Guests and subletting

Overnight guests are only permitted with the prior written consent of the Lessor and for an additional charge of EUR 25 per night. Subletting is not permitted. Unregistered overnight stays will be charged at EUR 200 per night.

5.4 Return of the apartment

The apartment must be returned in proper condition on the last day of the rental period by 12:00 noon at the latest. Personal belongings must be removed and the apartment must be left swept clean.

6. Termination of the tenancy

6.1 Automatic end of contract

The tenancy ends automatically at the end of the rental period specified in the booking confirmation. Any tacit extension of the tenancy is expressly rejected.

6.2 Extraordinary termination

The landlord is entitled to terminate the tenancy agreement extraordinarily and without notice if the tenant violates essential parts of the contract or the house rules. In this case, the tenant shall owe the rent for the entire agreed term as compensation, unless the tenant can prove that the landlord has suffered less damage.

6.3 Premature termination by the Tenant

Premature termination of the tenancy by the Tenant is excluded. There is no ordinary right of termination during the rental period.

7. Liability of the landlord

7.1 Exclusion of liability

The strict liability of the Lessor for initial defects of the rental object is excluded. The Lessor shall only be liable for defects that occur after conclusion of the contract if these are due to intent or gross negligence on the part of the Lessor or its vicarious agents.

7.2 Liability for personal injury

Liability for damages resulting from injury to life, body or health shall remain unaffected if these are based on an intentional or negligent breach of duty by the Lessor or its vicarious agents.

7.3 Liability for valuables

The landlord accepts no liability for the loss of valuables or personal belongings of the tenant.

8. Internet use

8.1 Provision and use

The Landlord shall provide the Tenant with access to the WLAN network during the rental period. The access data will be communicated to the Tenant upon moving in. Use of the Internet is at the Tenant's own risk and responsibility.

8.2 Obligations of the tenant

The tenant undertakes not to use the Internet for illegal purposes, in particular not for: downloading, distributing or making available copyrighted material without authorization, distributing harmful software (viruses, Trojans, etc.), attempting to access third-party networks or systems without authorization (hacking).

8.3 Liability and indemnification

The Lessee shall be liable for all damage incurred by the Lessor as a result of misuse of the Internet access. The Lessee shall indemnify the Lessor against all third-party claims based on unlawful use by the Lessee.

8.4 Restrictions and blocking

The Lessor reserves the right to block Internet access without prior notice in the event of a breach of these provisions.

9. House rules

9.1 General behavior

Tenants undertake to behave in a considerate and community-promoting manner. Other residents must not be disturbed or disadvantaged in their privacy.

9.2 Cleanliness and tidiness

Communal areas must be left tidy at all times. Personal belongings, crockery, waste or leftover food must not be stored there. In private rooms, attention must be paid to cleanliness and proper storage of food. Cooking in private rooms is prohibited.

9.3 Use of the communal kitchen

Each tenant has an allocated storage space and a compartment in the refrigerator. After use, used kitchen utensils must be placed in the dishwasher and all surfaces cleaned.

9.4 Waste separation

Waste must be properly separated into residual waste, paper, plastic and organic waste. It is prohibited to dispose of waste or harmful liquids in toilets, sinks or showers.

9.5 Quiet times

Monday to Saturday: 22:00 - 08:00 hours. Sundays and public holidays: additionally from 12:00 - 13:00. Noise must be limited to room volume.

9.6 Guests

Daytime visitors are welcome during normal hours (08:00–22:00) as long as this does not violate the agreement of sole use or disturb other residents. Overnight guests are only permitted with the prior written consent of the landlord and come with an extra charge of €25 per night. Unauthorized overnight stays will be charged at three times the nightly rate per night of the booking rate.

9.7 Fire protection

The storage of objects in corridors or stairwells is prohibited. The Tenant undertakes to inform himself/herself about the applicable fire protection measures.

9.8 Smoking and Pets

Smoking is prohibited throughout the building. Pets may not be brought into the building. A contractual penalty of EUR 500 shall be payable in the event of a breach.

9.9 Internet Use

WLAN access is provided during the rental period. Use is at the tenant's own risk. In particular, the tenant undertakes not to use the internet for: illegally downloading, distributing or making available copyrighted material; spreading viruses or malware; hacking or unauthorized intrusion into third-party networks. In the event of misuse, the tenant shall be liable for all damages and shall indemnify the landlord against any possible claims by third parties. The Landlord is entitled to block Internet access without prior notice in the event of violations.

9.10 Right of access

In urgent cases (e.g. emergency, need for repairs), the landlord may enter the apartment without prior notice.

9.11 Chip card

The access card is personal and may not be passed on to third parties. Any loss must be reported immediately. The card must be returned to Hotel Krone when moving out.

9.12 Liability

The Landlord accepts no liability for the loss of personal items or valuables belonging to the Tenant.

9.13 Violations

Violation of these house rules may result in termination of the tenancy without notice and a ban from the premises.

10. Electronic Contract and Signature

10.1 Digital Contract Execution

Both parties agree that the rental contract is concluded electronically through DocuSign. A digitally signed copy is legally binding without handwritten signature (§ 126a BGB). The tenant will receive the contract via email and must review and sign it digitally.
